Terms of sale
1. Who these terms are for
This website sells to businesses. By placing an order you confirm you are buying in the course of a business, and the cancellation rights that consumer regulations give to private individuals do not apply.
2. Who you are buying from
ELECTAC Ltd, registered in England and Wales, company number 06427393. Registered office: 9 Brookway Trading Estate, Hambridge Lane, Newbury, Berkshire, England, RG14 5PE. VAT registration number GB922381144. Telephone 01635 581 535, email sales@electac.com.
3. Prices
All prices are shown excluding VAT, which is added at 20% at checkout. The site shows both figures and there is a switch on every page. The price that applies is the one displayed when you place your order. Items marked price on request cannot be bought directly and are quoted per job.
A written quotation stands for 30 days from its date unless it says otherwise.
4. Carriage
Delivery is free to British mainland addresses, whatever you order and however much of it. There is no carriage charge and no minimum order to qualify for it.
We deliver to the British mainland only. The Scottish Highlands and Islands, Northern Ireland, the Isle of Man, the Channel Islands and export are not priced on the site and are not ordered through it. Ring us and we will quote carriage for the delivery address before you commit to anything.
5. Delivery
Lead times are shown on each product and are estimates given in good faith, not guarantees. We will tell you if an item is going to take materially longer than the time shown when you ordered.
Risk in the goods passes to you on delivery. Title stays with us until we have been paid in full.
6. Payment
Card payments are processed by Stripe. Electac never see or hold your card details. Your card is charged when you place the order. If we cannot fulfil the order we refund you in full.
Trade accounts may pay against a purchase order.
Accounts are opened at our discretion and are payable 30 days from the date of invoice. We may charge interest on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998.
7. Returns, cancellations and faults
Damage or shortage in transit must be reported within 48 hours of delivery. After that we cannot claim against the carrier and cannot put it right at our cost. Telephone 01635 581 535 or email sales@electac.com and keep the packaging.
Unwanted stock items may be returned within 14 days of delivery if they are unused, complete and in their original packaging. Ask us first, so we can tell you where to send them. Return carriage is yours, and we may deduct a handling charge from the refund.
Anything built, modified or supplied to order cannot be returned because it is unwanted. Much of the range is made to the job, so if you are unsure whether an item is stock, ask before ordering.
If something is faulty, ring us. We will normally ask you to return it to the Newbury base for inspection, at our cost once a fault is confirmed, and then repair it, replace it or refund it.
8. Warranty and servicing
Equipment is warranted for 12 months from delivery against defects in materials and workmanship.
Filters, hoses, sleeves and other consumable and wear parts are not covered, since they are consumed in normal use. Nor is damage from misuse, accident, unauthorised modification, or a failure to install and maintain the equipment as section 10 requires.
We service and repair our own equipment at the Newbury base. Work under warranty is free; routine servicing outside the warranty is chargeable and we will tell you the cost before starting.
9. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If any other part of this section conflicts with that, this paragraph wins.
Subject to that, if goods we supply are defective our responsibility is to repair them, replace them or refund what you paid, at our option, and our total liability for any order will not exceed the price you paid for it.
We are not liable for indirect or consequential loss, or for loss of profit, production, contracts, business or goodwill, however it arises.
This equipment is supplied to help control fume and dust. It does not relieve you of your own duties as an employer, and section 10 sets out what remains yours.
10. Using the equipment
Equipment must be installed, used and maintained in accordance with the manufacturer's instructions supplied with it.
Assessing the risk in your own workplace remains yours. That includes your assessment under the Control of Substances Hazardous to Health Regulations 2002, and arranging the thorough examination and test that those regulations require for local exhaust ventilation.
Where we advise on which unit suits a job, that advice is given in good faith on the information you give us. It is not a substitute for a competent assessment of your own process.
11. Quotes and purchase orders
A quote request is not an order. We record your basket and your request, come back with carriage and a total, and nothing is charged until you agree it.
A purchase order is an offer to buy. The contract is formed when we accept it, which lets us decline an order we cannot fulfil rather than leave you waiting on one.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
